Iraqi Presidential decree needed to implement death sentences  5.9.2007

BAGHDAD, -- The National Legal Consultation Council (NLCC) in Iraq said that it is not legal to implement the death sentences handed down by the Supreme Criminal Court without a presidential decree, Vice President Tariq al-Hashemi's office said on Wednesday in a statement.

"The vice president requested a legal opinion from the NLCC about the necessity of a presidential decree to carry out the death sentences handed down by the Supreme Criminal Court, according to the first clause of article 6 of law number 65 in 1979," al-Hashemi's office said.

"The NLCC informed al-Hashemi that it is not legal to implement the death sentences without a presidential decree," said the statement.

The Supreme Criminal Court executed former president Saddam Hussein, his brother Barzan Ibrahim al-Hassan, Awad Hamad al-Bander and Taha Yassin Ramadan, who was found guilty in the Dujail case, without a presidential decree.

The statement said that al-Hashemi's office sent a message to the prime minister's office, the headquarters of the presidential council, the justice ministry, the general prosecution chairmanship and the Supreme Criminal Court with the NLCC opinion attached.

"The Iraqi Supreme Court has confirmed the death sentence on "Chemical Ali" Ali Hassan al-Majid, Sultan Hashim al-Tai and Hussein Rashid al-Tikriti," the court head Judge Aref Shaheen said on Tuesday.

Majid, widely known as "Chemical Ali," was the executed Iraqi dictator's most notorious hatchet man, Tai was his defence minister and Tikriti was armed forces deputy chief of operations.

The three were sentenced to death on June 24 after being found responsible for the slaughter of thousands of ethnic Kurds in the so-called Anfal campaign of 1988.

They will be hanged within 30 days in line with Iraqi law.
