Australia: Court stops Kurdish sick man's
deportation

(Jan 18), -The Federal Court has intervened to stop
the deportation of a Turkish Kurd, ruling that such
a move was likely to significantly worsen his
already severe mental condition.
The Immigration Department had intended to deport
Ali Beyazkilinc, 45, early this morning, despite
medical advice that he suffered depression, anxiety
and probable post-traumatic stress disorder.
But Justice John Mansfield last night granted an
urgent application to stop the deportation. He did
so after learning that the South Australian
Guardianship Board had held an emergency meeting
yesterday to order a three-week treatment order for
Mr Beyazkilinc, who has previously tried to commit
suicide.
The department had arranged for Mr Beyazkilinc to be
transferred from Baxter detention centre to Sydney
for a flight to Istanbul, accompanied by three
police officers and a psychiatric nurse. The
department had booked 140 seats on the plane to
prevent disruption.
The department's lawyer, Sashi Maharaj, told the
court that forcible deportation was an adverse
experience for most detainees. "(But) fitness to
undertake the journey does not mean the applicant
has to be in an absolute pristine condition," he
said.
