Talabani accuses Al Ja'fari of "Assaulting the Kurds' Rights" 11.7.2005

 



Baghdad: Jalal Talabani, the president, has accused Ibrahim Al Ja'fari, the Prime Minister, of converting his Kurdish deputies to "ministers without work" and of "assaulting the rights of the representatives of the Kurdish people".

In a message addressed to Al Ja'fari, which Al Hayat has received a copy of, stated that the latter has "violated" some of the most prominent articles of the agreement signed between "the Shiite Coalition" and "the Kurdistani Alliance", "violating" the most prominent articles of the state administration code for the transitional stage and acting in "a very clear individuality and neglecting the jest and spirit of the signed agreement" between the two parties, in addition to the law, which he said "should prevail until the new constitution is legislated".

 In his message, Talabani expressed his resentment towards Al Ja'fari's creation of 9 ministerial committees, all connected to him and consequently "converting the Prime Minister deputies to ministers without a job or work", referring to the Kurdish deputy Prime Minister, Ruz Shawis.

Talabani considered that as "an assault against the rights of the representatives of the Kurdish people and the national accord." In the 6th paragraph of the message, Talabani criticized Al Ja'fari for "specifying the competence of ministers, including Dr. Barham Saleh, without a legal justification or a right." He considered this procedure as "deprivation" of "half of his rights, instead of adding other rights, as agreed upon, with the coalition, immediately after the creation of the government." The 6th paragraph has also referred to "alienating the Kurdish ministers from everything related to economy, money and armed forces." The message described Al Ja'fari's decision to release all Iranian prisoners, without consulting the ministry and the republic presidency, as "illegal decisions".

Talabani stated, "The legal violations" of Al Ja'fari and accused him of "neglecting the reality of the ministry", which is "a part of the government. You act as if the government is only you, and you restrict its competence into your own identity", which he considered as a plain violation of the text of the two articles 24 and 25 of the state administration code, which state "the government consist of the state presidency, the National Assembly presidency, the premiership and the ministers' council and that setting the government policy is the duty and competence of the three authorities, not only the prime minister." Talabani added, "Unfortunately, we noticed that you ultimately neglect the presidency council and the National Assembly presidency."

As regards the program of Al Ja'fari's government, the message referred to the violation of this program "of the accord principle, pursuant to the section of article 1, which necessitates accord in taking basic political, security, economic and administrative decisions. In addition, the program neglects the provisions of article 3, relating to the agreement of the Shiite Coalition with the Kurdistani Alliance."

As for Kirkuk, Talabani considered the Prime Minister's practical situations in his decisions "relating to stopping the cashing of the necessary sum for normalization in Kirkuk, as you are practically taking an opposing and conflicting stand, if not hostile, against the rights of Kurdish people in Kirkuk." He pointed out that the text of section 2 "article 4" of the state administration code, necessitates that the transitional government, "within a period of not more than one month of its creation, should activate the normalization procedures, including the provision of finance for the council of normalizing conditions in Kirkuk and the property dispute council."

Talabani considered Al Ja'fari's negligence of Kirkuk issue "as a very crucial matter, which should not be left intact on behalf of the Kurdistani Coalition."

Within the same context, Joan Fouad Ma'sum, communication minister, (from the Kurdistani Alliance), confirmed that Al Ja'fari "did not correct (did not adopt) any of the sections of Talabani's message, so far." "We did not discuss these topics in the ministers' council in any way until now."

She denied her knowledge of decisions issued by Al Ja'fari, in the name of the ministers' council, including a decision relating to the existence of the multinational forces, or his decision to "release Iranian prisoners in Iraq".

At the end of his message to Al Ja'fari, Talabani stressed, "The necessity of executing the state administration code for the transitional period and sticking to the agreement signed between the Kurdistani Alliance and the Shiite Coalition." He demanded him to stress various matters, including, "coordination and cooperation with the Iraqi government authorities (the presidency council, the National Assembly presidency and the ministers' council), setting a clear system, through which the three government authorities would execute their duties, which are stated in article 25 of the state administration code and that the Prime Minister should immediately activate the procedures of normalization in Kirkuk, including the provision of necessary money for the work of the normalization council and the property dispute council."

He also demanded him to issue orders to the finance ministry "to free the grant, designated for Kirkuk province from the former government and taking legal procedures to cancel the decisions of the dissolved revolution command council, to adopt the policy of racial elimination." He called him to "work in accordance with the state administration code and the articles of the agreement signed between the Shiite Coalition and Kurdish Alliance, so that brotherhood and cooperation would continue among us and so that we would not be forced to use our right in article 6 of the agreement protocol." He pointed out, "We cannot keep silent and accept posing the fait accompli on us, contrary to law and the agreement."
