Cemile
Gundogdu, news-caster of the Dunya Radio station and
Fatih Demir, broadcast director, who were brought
before the judge for using the phrase 'KONGRA-GEL's
Institutional President Dear Ocalan' while air
casting Kurdish People's Leader Abdullah Ocalan's
statements published on the Ülkede Özgür Gündem,
have been acquitted.
The case which had been opened against Cemile
Gundogdu and Fatih Demir on May.3, 2004 for
mentioning 'KONGRA-GEL's Institutional President
Dear Ocalan' to the radio audience at the time
airing news published on the Ülkede Özgür Gündem has
been brought in the verdict of non guilty by the 7th
Aggravated Felony Court of Adana. Because of the
lack of substantive evidence, court adopted
acquittal sentence at the 4th trial of hearing which
had been lunched in accordance with Article 7/2 of
the Anti-Terrorism Law, that is, "To make propaganda
of an outlawed organization via broadcasting and to
encourage people to terror actions."
'It would be a forensic tragedy'
Fatih Demir, broadcast director stated the judgment
has been adjudicated as it should be and an opposite
decision would forensic tragedy. Cemile Gundogdu
indicated that she offers the news items collected
from dailies like Radikal, Milliyet, Evrensel, Sabah
and Ülkede Özgür Gündem and prefers using a
different wording from official language as a result
of independent airing principles. "What governmental
officials say 'terrorist' and 'terror' are just a
comment for us. When we address to people, we use
their names as a requirement of respect and do not
use glowing or injurious expressions. What's more,
Mr Ocalan a political person, whose opinions are
given value in Turkey and Middle East. We appraise
the adoption to be rightful. It is a decision that
should have been made. We hope it will constitute a
precedent for similar trials."
Attorney Kılıç: A positive development
Huseyin Kılıç, pointed out the attorney of the two,
the verdict of not guilty forms precedent and
said;"For Yeter Cemile Gundogdu did not tell her own
opinions and just shared an item of news with
listeners; therefore, cited words do not belong to
herself. We stressed on those at our defenses and,
the court decides in our favour and should made
necessary judgment."
'Dissolution case is going on'
Meanwhile the cause the Turkish Ministry of Commerce
and Industry had brought against the company to
which the radio station depends upon, showing the
hearing at 7th Aggravated Felony Court of Adana as
proof and claiming that the radio station is doing
separatism, is keeping on.
