Turkey convicted in the Guclukonak case by ECHR
Turkey, Nov 23 - The European Court of Human Rights
(ECHR) convicted Turkey for its security forces
machine-gunning 11 Kurdish villagers in a van and
then setting it on fire outside the town of
Guclukonak in the Sirnak province of northern
Kurdistan (southeastern Turkey) on January 15, 1996.
Turkey was convicted for violating the right of
life, security and freedom. 9 relatives of the
villagers will get between 18,000-20,000 Euro
(~21,000-23,500 US$) in compensation.
A delegation organized by the trade unionist Sanar
Yurdatapan found evidence that the villagers, which
were mainly pro-state paramilitary Village Guards,
had been killed by Turkish security forces in an
attempt to discredit a unilateral cease-fire
declared by the PKK in December 1995. Yurdatapan was
later prosecuted under the old articles 158 and 159
of the Turkish Penal Code for taking part in a BBC
television program, which implicated that the
Turkish security forces carried out the massacre.
The old articles 158 and 159 penalized everybody
'insulting the President or the Turkish nation, the
Republic, the Grand National Assembly or the moral
responsibility of the judicial authorities'. In
Turkey's so-called "reforms", the Article 158 turned
into Article 300 and Article 159 turned into Article
302.
The new articles read as following:
Article 300 (new form of Article 158) - Insulting
the President of the Republic: up to 4 years (if
committed by the means of media, to be increased
one-third).
Article 302 (new form of Article 159) - Insulting
the Turkish national identity, the Republic or the
Grand National Assembly of Turkey: up to 3 years (if
committed by a Turkish citizen abroad: to be
increased one-third); Insulting the Turkish
Government, the judicial organs, military or
security institutions: up to 2 years (if committed
by a Turkish citizen abroad: to be increased
one-third).
'Accomplice List' from the Car in Semdinli
HAKKARI Nov 23 (DIHA) - A list titled as 'Who
helped us' came out of the car that was used by the
security members claimed to commit the bombings at
Umut Bookstore in Şemdinli, Hakkari. The names on
the list belonged to those in collaboration with
JİTEM (Gendarmerie Intelligence) and there were
names and phone numbers.
A list of names to be pursued in the region, names
in collaboration with the JİTEM, maps of a few shops
and houses, was found in the car that belonged to
officers named A.K and Ö.İ. They were said to commit
the bombings in Şemdinli on 9th November. There are
names of firm managers, village headmen, and members
of political parties and common people
These are the names with telephone numbers on the
list titled 'Who helped us':

Erenkaya village raided by Turkish soldiers
Nov 23 - Turkish soldiers raided the Kurdish village
of Erenkaya in the Eruh district of Siirt in
northern Kurdistan (southeastern Turkey) on Nov. 22.
Nine villagers were detained by Turkish security
forces.
The village has been surrounded by Turkish soldiers
since Kurdish HPG guerrillas attacked a Turkish
military base close to Erenkaya on Oct. 28, killing
20 soldiers. Tuesday's raid was the third in a short
time.
The names of the nine detained villagers are Resül
Özer, Veysel Aslan, Emin Tas, Tahir Basut,
Abdurrahman Ertas, Hasan Kayar, Selahattin Basut,
Emine Yildiz and Masallah Yildiz. The absent village
reeve (muhtar) Nurettin Yildiz was put on a wanted
list by the Turkish soldiers.
